ZONING BOARD OF APPEALS MEETING MINUTES
WEDNESDAY, AUGUST 5, 2015

A meeting of the Zoning Board of Appeals (ZBA) was held on Wednesday, August 5, 2015. Mr. Heney called the meeting to order at 7:08 PM in the Community Meeting Room.

ATTENDANCE:
PRESENT: Daniel Heney (Chairman), Pamela Holmes (Vice Chairman), John Bombara, Sean Holland, Michael Fitzpatrick (Alternate) and Maria Lajoie (Administrative Secretary)
ABSENT: Leonard Demers (Excused)

7:08 PM ZBA CASE #2015-04 PUBLIC HEARING CONTINUED: ISLAMIC SOCIETY OF GREATER WORCESTER, 170 West Street
Mr. Heney read a letter from the applicant dated July 29, 2015 asking to withdraw their special permit application without prejudice.
Mr. Bombara made a motion to accept the withdrawal of ZBA Case #2015-04, Islamic Society of Greater Worcester, 170 West Street, without prejudice. Ms. Holmes seconded the motion. Vote: Unanimous.

DISCUSSION:
1. MINUTES: June 3, 2015, & July 1, 2015
Ms. Holmes made a motion to approve the June 3, 2015 Zoning Board of Appeals meeting minutes as amended. Mr. Holland seconded the motion. Vote: Unanimous.
Mr. Bombara made a motion to approve the July 1, 2015 Zoning Board of Appeals meeting minutes as presented. Mr. Fitzpatrick seconded the motion. Vote: Unanimous.
2. North Village, LLC: There was correspondence in the packet for review regarding the retention ponds and where stumps are being placed.

7:15 PM ZBA CASE #2015-07 PUBLIC HEARING CONTINUED: KENNETH CANDITO, 128 Northwest Main Street
Mr. Heney recused himself. Ms. Holmes took over as Chair. Mr. and Mrs. (Nancy) Candito joined the meeting. Ms. Holmes has visited the site and she has met several neighbors. Mr. Candito spoke about the dimensions of the proposed house
Patrick Burke of HS&T Group joined the meeting. There has been a site visit by the Conservation Commission and they are now waiting a decision from the ZBA.
The proposed house will be two-stories in a neighborhood of one-story homes. It will be a year-round residence. Ms. Holmes is concerned that the two-story house will block the view of the lake. Mr. Candito stated that there are 6-10 two-story homes on the lake. Behind his property, it is heavily wooded.
Mr. Bombara made a motion to close the public hearing, ZBA Case #2015-07, Kenneth Candito, 128 Northwest Main Street. Mr. Fitzpatrick seconded the motion. Vote: Unanimous.
Mr. Bombara made a motion to open a decision hearing, ZBA Case #2015-07, Kenneth Candito, 128 Northwest Main Street. Mr. Holland seconded the motion. Vote: Unanimous.
Mr. Bombara made a motion to approve the special permit for Kenneth Candito, 128 Northwest Main Street, with the plans as presented and following the Conservation Commission’s rules and regulations. Mr. Holland seconded the motion. Vote: Unanimous.
Mr. & Mrs. Candito and Mr. Burke left the meeting. Mr. Heney rejoined the meeting and resumed as Chair.

DISCUSSION (Cont.):
3. ZBA Alternate Applications (2): The Board of Selectmen (BOS) received two applications for the alternate position on the ZBA. The BOS is asking for a written recommendation on the applicants. The ZBA reviewed the applications.
Ms. Holmes made a motion to recommend Ross Smith to the position of Alternate on the ZBA. Mr. Bombara seconded the motion. Vote: Unanimous.
The members added a comment to the draft letter supportive of Mr. Smith’s qualifications as a life-long resident and education and experience in the engineering field.

OPEN SESSION:
Signatures for Decisions Submitted to the Clerk: Mr. Heney stated that in the event that not all the signatures of committee/board members can be obtained on a decision, Town Counsel has stated that only the signature of the Chair or Vice Chair of a committee/board is needed on a decision for it to be valid and recorded. Ms. Lajoie stated that the Town Clerk, Chris Furno, stated that that had been the procedure in the past. Mr. Heney stated that his preference would be to have all signatures. To have only one signature or less than all members’ signatures would be a last resort. A discussion was held.
Mr. Bombara suggested that members respond to Ms. Lajoie immediately if they are not able to come in to sign a document in a reasonable amount of time. The object is to not hold up the applicant.
Ms. Holmes made a motion that, in order to make decisions in a timely manner, the ZBA will proceed to allow the Chairman or Vice Chairman to sign decisions on behalf of the ZBA members, when necessary. Mr. Holland seconded the motion. Vote: Unanimous.

Mr. Bombara acknowledged Sue VanderCight of Uxbridge who was in attendance for the first agenda item and remained present for the entire meeting. She asked whom would she speak with to see if the Town would like to purchase 170 West Street. The ZBA suggested she contact Michael Guzinski or Suzanne Kane.

7:47 PM ADJOURNMENT:
Mr. Bombara made a motion to adjourn the meeting at 7:47 PM. Mr. Holland seconded the motion. Vote: Unanimous.
