CONSERVATION COMMISSION MEETING MINUTES
MONDAY, DECEMBER 7, 2015

A meeting of the Conservation Commission was held on Monday, December 7, 2015. Ms. Brown called the meeting to order at 7:02 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman-arrived 7:08 PM) Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

7:02 PM (NOI-DEP #143-0886) PUBLIC HEARING CONTINUED – 74 Main Street / NEW ENGLAND REALTY VENTURES, LLC
Ms. Brown stated that she has a letter from the applicant asking to withdraw the application without prejudice.

DISCUSSION:
1. Forest Cutting Plan: Mosczynski property, Oak & Northwest Main Streets. Mr. Zisk stated that Shirley Mosczynski has hired a forester to put a plan together to log some of their land. Ms. Brown did not see any stream crossings on the plan.
2. Request for a Certificate of Compliance: Joyce Guiou, 81 Main Street (DEP #143-0869). Mr. Zisk stated that the applicant came in a couple years ago because the pond was getting choked out. Ms. Sharkey stated that the shed was supposed to be relocated. A discussion was held. Mr. Zisk will email EcoTech and visit the site again.

7:15 PM (NOI-DEP #143-0892) PUBLIC HEARING CONTINUED-16 Cottage Colony/GUARANTEED BUILDERS & DEVELOPERS, INC.
Ms. Sharkey recused herself. Karen Keegan of Guaranteed Builders Inc. joined the meeting and stated that the applicant is looking to raze the existing multi-family dwelling and construct a single-family dwelling within the same footprint. It does not currently have a well. It has a tight tank. She has approvals from ZBA and Board of Health. No trees beyond the limit of disturbance are planned to be cut.
A discussion was held regarding the two decks. Ms. Van Roo did not feel that the plan was drawn accurately. The edge of the proposed house is beyond the existing footprint. There is an unidentified object on the plan that extends into the 25’ buffer zone. The Commission asked Ms. Keegan to come back with a revised plan. All limits of disturbance and erosion controls need to be shown on the plan.
Ms. Van Roo made a motion to continue the public hearing, NOI-DEP #143-0892, 16 Cottage Colony, Guaranteed Builders & Developers, Inc. to January 4, 2016 at 7:15 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:33 PM (NOI-DEP #143-0895) PUBLIC HEARING CONTINUED-115 Ledgestone Road/ STOCKWELL, DEBRA
Ms. Brown stated that the applicant asked for a continuance.
Ms. Van Roo made a motion to continue the public hearing, NOI-DEP #143-0895, 115 Ledgestone Road, Debra Stockwell to February 1, 2016 at 7:00 PM. Mr. Greco seconded the motion. Vote: Unanimous.

DISCUSSION (Cont.):
3. 2016 Meeting Schedule. Ms. Sharkey rejoined the meeting. The schedule was reviewed. Ms. Sharkey made a motion to approve the Conservation Commission 2016 Meeting Schedule as presented. Ms. Van Roo seconded the motion. Vote: Unanimous.
4. Request for a Certificate of Compliance: S & L Realty Trust, 147 Davis Street (DEP #143-0739). Mr. Zisk stated that some work never commenced, however some of the buffer has been cleared. The Order of Conditions has lapsed.
Ms. Sharkey made a motion to issue a Certificate of Compliance for S & L Realty Trust, 147 Davis Street as written. Mr. Greco seconded the motion. Vote: Unanimous.

7:45 PM (RDA) PUBLIC MEETING – 85 Franklin Street / BOULTER, JOHN
Ms. Brown opened the public meeting. Mr. Boulter joined the meeting. Mr. Zisk stated that some work has been done already. A violation had been issued and paid. The stumps are 60’ from the stream. Mr. Boulter is retroactively asking to remove five heavily damaged pine trees, loam and seed the area and erect a 10’ x 15’ shed. The trees have been removed and the shed was delivered and installed last week. Mr. Zisk saw the area that was staked out for the shed. Only a plan from 2002 exists. The shed is outside the Commission’s jurisdiction. Mr. Boulter showed the location of some trees that he may want to remove in the future. No additional work will be done.
Ms. Van Roo made a motion to close the public meeting and issue a negative RDA for John Boulter, 85 Franklin Street. Ms. Sharkey seconded the motion. Vote: Unanimous.
Ms. Sharkey asked Mr. Zisk that a plan with distances be provided for all future RDAs. The Commission concurred.

8:00 PM (NOI-DEP #143-0896) PUBLIC HEARING – 56 Bigelow Road / SPECYALSKI, BRIAN
Ms. Brown opened the public hearing. Mr. Specyalski joined the meeting. Mr. Zisk gave a history of the project and stated that straw bales were placed in response to a violation notice. Mr. Specyalski has paid the fine. A retaining wall has fallen over and silt has been going into the pond. Mr. Specyalski has hired someone to rebuild the wall, and he will be working with them. They will put ¾” trap rock and better soil behind the wall. The stockpile area is on the driveway. The soil will be dumped into place directly from a truck. The Commission stressed that no machinery can be parked or driven on the left hand side, upwards of the straw bales. Ms. Van Roo asked that the erosion control line be continued to the edge of the stone on both sides, beyond the extent of the work.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for NOI-DEP #143-0896, 56 Bigelow Road, Brian Specyalski with the following conditions: that they keep all equipment lawn side, no stockpiles and extend the erosion control on each edge to the extent of work. Ms. Sharkey seconded the motion. Vote: Unanimous.
Mr. Specyalski will call Mr. Zisk when he has extended the erosion control line before he starts work on the wall.

8:16 PM (ANRAD-DEP #143-0898) PUBLIC HEARING – 229 Main Street / RILEY, ALLEN G.
Ms. Brown opened the public hearing and then recused herself. Ms. Sharkey took over as Chairperson. Eric Bazzett of Heritage Design Group joined the meeting. The applicant has filed an Abbreviated Notice of Resource Area Delineation (ANRAD). A wetlands consultant (EcoTech) has delineated the wetlands on the project. It is an approximately 40 acre parcel. Mr. Bazzett acknowledges the intermittent stream that runs within the wetlands flags. He is asking the Commission to confirm that the boundaries are accurate. A subdivision is being planned for the property.
Mr. Zisk was concerned that there may be another area of isolated wetlands. He will obtain pricing for a third party consultant.
Ms. Van Roo made a motion to authorize Steven Zisk to solicit quotes for the delineation of said area for ANRAD-DEP #143-0898, Allen G. Riley, 229 Main Street, not to exceed $2,500. Mr. Greco seconded the motion. Vote: Unanimous.

Ms. Brown rejoined the meeting and resumed as Chairperson.

8:38 PM (NOI-DEP #143-0897) PUBLIC HEARING – 50 Cedar Street / DUPONTE, CHARLES
Ms. Brown opened the public hearing. Paul Hutnak of Heritage Design Group joined the meeting. He stated that the property is the historic site of a town beach. There is a well-defined park path that comes through the property. There are also remains of park buildings, which they plan to remove. There are some infested hemlocks they also plan to remove.
Mr. Hutnak proposed a gravel driveway and constructing a new single-family dwelling with septic, well and a deck. A retaining wall will be constructed on the road side of the house. On the downhill side of the driveway, they propose a stone filter strip 2’ wide by 2’ deep. Mr. Hutnak proposed a split-rail fence to frame the driveway and a boulder/stone wall 2’ to 4’ tall to the cart path, to be designed. There is a removable dock that is not on the NOI.
There is an area they plan to mow, score with a York rake, and seed with native seed mix. Mr. Hutnak proposed native shrub plantings.
Mr. Hutnak will get information about the removable dock.
A discussion was held regarding the position of the house on the lot. Michael Silva, architect explained the reasoning.
Mr. Hutnak will flag the trees to be removed.
Nicole Catusi, 583 Northwest Main Street, was concerned that her view of the water would be obscured. She is also worried that deer and wildlife will not be able to get to the water. Mr. Hutnak explained that the house is down the road quite a way, and the house is pointed diagonally on the lot.
A site walk was planned for December 16, 2015 at 3:00 PM.
Ms. Sharkey made a motion to continue the public hearing, NOI-DEP #143-0897, 50 Cedar Street, Charles DuPonte to January 4, 2016 at 7:45 PM. Mr. Greco seconded the motion. Vote: Unanimous.

DISCUSSION (Cont.):
5. Request for a Certificate of Compliance: Annette G. Foshee, 238 Perry Street.
Ms. Sharkey made a motion to issue a Certificate of Compliance for Annette G. Foshee, 238 Perry Street. Ms. Van Roo seconded the motion. Vote: Unanimous.
6. Request for a Certificate of Compliance: Joshua Berube, 29 Colonial Road (DEP #143-0870). The Commission needs the request and the original paperwork. Mr. Zisk will ask Maria Lajoie for those items.
7. National Grid: 45 Day Yearly Operational Plan dated 11/19/15. Mr. Zisk stated that National Grid is filing their maintenance plan. He does not see any issues.
8. Request for Project Review: JMT Sleepy Hollow (Preliminary Subdivision Plan), 439 Northeast Main Street & 34 & 36 Davis Street. It was the consensus of the Commission that the applicant needs to file.
9. 2015 Annual Report (due before January 31st). Mr. Zisk will take care of this.

Ms. Sharkey made a motion to approve the November 2, 2015 Conservation Commission meeting minutes as presented. Mr. Greco seconded the motion. Vote: Aye-3, Ms. Van Roo abstained.
