ZONING BOARD OF APPEALS MEETING MINUTES
WEDNESDAY, DECEMBER 13, 2017

A meeting of the Zoning Board of Appeals (ZBA) was held on Wednesday, December 13, 2017. Mr. Heney called the meeting to order at 7:07 PM in the Community Meeting Room.

ATTENDANCE:
PRESENT: Daniel Heney (Chairman), Michael Fitzpatrick, Leonard Demers, Louis Tusino (Alternate), Maria Lajoie (Administrative Secretary)
ABSENT: Sean Holland (Excused), Pamela Holmes (Vice Chairman-Excused), John Bombara (Excused)

7:07 PM PUBLIC HEARING CONTINUED: ZONING BOARD OF APPEALS, Proposed Amendments to the Regulations Governing Fees and Fee Schedules.
Larry Lench, Building Inspector joined the meeting. He stated that Town Counsel Atty. Jay Talerman adding language concerning fines.
Mr. Demers made a motion to recommend to the Planning Board to adopt the Proposed Amendments to the Regulations Governing Fees and Fee Schedules and Town Counsel’s recommendation. Mr. Fitzpatrick seconded the motion. Vote: All-Aye.

7:14 PM CASE #2017-10 PUBLIC HEARING: DONALD FARINEAU, 294 Northwest Main Street.
Mr. Heney opened the public hearing. The Planning Board had no objection to the application. Eric Bazzett of Heritage Design and Mr. Farineau joined the meeting. They are proposing to remove the existing house and erect a new house with a new septic system and a new well. The septic plan has been approved by the Board of Health. The house will be more centrally located on the lot. The lot is actually on a 10’ wide right-of-way that goes back to Northwest Main Street. Mr. Bazzett reviewed the plan. A discussion was held.
Mr. Demers made a motion to close the public hearing for case #2017-10, Donald Farineau, 294 Northwest Main Street. Mr. Tusino seconded the motion. Vote: All-Aye.
Mr. Demers made a motion to grant the special permit for case #2017-10, Donald Farineau, 294 Northwest Main Street per the plans submitted. Mr. Tusino seconded the motion. Vote: All-Aye.

7:30 PM CASE #2017-08 PUBLIC HEARING CONTINUED: ROBERT PARENT & CAROLE DOLAN, 12 Roslyn Road.
Mr. Heney stated that he received a letter from the applicant stating that they are withdrawing their application for the variance.
Mr. Fitzpatrick made a motion to accept the applicant’s withdrawal letter for case #2017-08, Robert Parent and Carole Dolan, 12 Roslyn Road. Mr. Tusino seconded the motion. Vote: All-Aye.

7:32 PM CASE #2017-11 PUBLIC HEARING: ROBERT PARENT & CAROLE DOLAN, 12 Roslyn Road.
Mr. Heney stated that since Mr. Tusino is an abutter and three other members are absent, the hearing will need to be continued due to lack of quorum.
Mr. Demers made a motion to continue the public hearing for case #2017-11, Robert Parent and Carole Dolan, 12 Roslyn Road to January 10, 2018 at 7:15 PM. Mr. Tusino seconded the motion. Vote: All-Aye.
Mr. Tusino left the meeting.

7:45 PM CASE #2017-12 PUBLIC HEARING: ROBERT PARENT & CAROLE DOLAN, 12 Roslyn Road.
Mr. Heney stated that since Mr. Tusino is an abutter and three other members are absent, the hearing will need to be continued due to lack of quorum.
Mr. Fitzpatrick made a motion to continue the public hearing for case #2017-12, Robert Parent and Carole Dolan, 12 Roslyn Road to January 10, 2018 at 7:00 PM. Mr. Demers seconded the motion. Vote: All-Aye.

DISCUSSION:
1. 2018 Meeting Schedule. The schedule was reviewed. Mr. Demers made a motion to accept the 2018 ZBA Meeting Schedule as presented. Mr. Fitzpatrick seconded the motion. Vote: Aye-3.
2. Annual Town Report. A change was made to say that the meetings were changed mid-year to the second Wednesday of the month. Mr. Demers made a motion to accept the Annual Town Report with the change as noted. Mr. Fitzpatrick seconded the motion. Vote: Aye-3.
3. Voucher.
4. MINUTES: November 8, 2017.
Mr. Fitzpatrick made a motion to approve the November 8, 2017 minutes of the ZBA meeting as amended. Mr. Demers seconded the motion. Vote: All-Aye.

7:46 PM ADJOURNMENT:
Mr. Demers made a motion to adjourn the ZBA meeting at 7:46 PM. Mr. Fitzpatrick seconded the motion. Vote: All-Aye.
