CONSERVATION COMMISSION MEETING MINUTES
MONDAY, JANUARY 8, 2018

A meeting of the Conservation Commission was held on Monday, January 8, 2018. Ms. Brown called the meeting to order at 7:06 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Brandi Van Roo
ABSENT:
NON-VOTING: Stephen Zisk (Conservation Agent)

7:06 PM (NOI-DEP #143-0942) PUBLIC HEARING CONTINUED: 135 Webster Street/BOYKO, ERIC.
Mr. Boyko joined the meeting. Ms. Brown stated that at the last meeting, it was stated that the Commission needed an as-built, needed to know if the original file was still open, and needed to know the location of the National Heritage Endangered Species (NHESP) line.
Mr. Boyko stated that he gave Ms. Lajoie paperwork to do the Certificate of Compliance for the old DEP number. There was no request for a Certificate of Compliance. Tomorrow, Mr. Boyko will meet with Mr. Zisk and ask the Board of Health (BOH) for the septic as-built.
Ms. Van Roo made a motion to continue the public hearing for (NOI-DEP #143-0942) Eric Boyko, 135 Webster Street to February 5, 2018 at 7:15 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

7:15 PM (NOI-DEP #143-0934) PUBLIC HEARING CONTINUED: 294 Northwest Main Street/FARINEAU, DONALD.
Eric Bazzett of Heritage Design Group joined the meeting. He stated that ZBA approval was received.
Ms. Sharkey made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0934) 294 Northwest Main Street, Donald Farineau for the plan dated 11/14/17. Mr. Greco seconded the motion. Vote: Aye-3, Ms. Van Roo abstained.

7:33 PM (ANRAD-DEP #143-0936) PUBLIC HEARING CONTINUED: 30, 46 & 50 Southwest Main Street/BASILE, LAWRENCE.
Ms. Brown has not received any information from the engineer. Art Allen of EcoTec wrote up an enforcement order. Ms. Brown had replied to Mr. Allen’s email saying that a date was needed for filing the restoration plan, and “per the Douglas Wetland bylaw” needed to be added to the document. The order has not yet been edited. Neither a Cease and Desist nor a fine has been issued.
The Commission set a deadline of March 1, 2018 for the restoration plan to be filed. If a plan has not been filed by March 1, 2018, fines may be assessed.
Ms. Van Roo made a motion to close the public hearing and deny (ANRAD-DEP #143-0936) 30, 46 & 50 Southwest Main Street, Lawrence Basile due to insufficient information. Ms. Sharkey seconded the motion. Vote: Unanimous.

7:40 PM (NOI-DEP #143-0938) PUBLIC HEARING CONTINUED: 66 Southwest Main Street/MOTA, MILTON.
Eric Bazzett of Heritage Design Group joined the meeting. Taxes have been paid. The situation regarding the driveway has been remedied.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0938) Milton Mota, 66 Southwest Main Street. Ms. Sharkey seconded the motion. Vote: Unanimous.

7:56 PM PUBLIC MEETING: 73 Ledgestone Road/STEELE, Joan.
Laura and Pete Burgess of 75 Ledgestone Road joined the meeting. Joan Steele is Ms. Burgess’ mother. Ms. Steele is proposing a 32’ x 40’ garage to be built in the middle of the property on a slab. There is an intermittent stream. The stockpile area will be on the opposite side of the driveway.
It was noticed that the applicants plan to build the garage on the reserve area for the septic, and the plan may not receive BOH approval.
It was the consensus of the Commission that the applicants need to supply a detailed plan showing the exact location of the proposed garage, stockpile site, and erosion controls.
Ms. Van Roo made a motion to postpone the public meeting for Joan Steele, 73 Ledgestone Road to later in the meeting.
9:04 PM – meeting resumed. Mr. and Mrs. Burgess rejoined the meeting and presented the plan with measurements noted on it. Only straw wattles will be used as erosion controls and staked no farther than 10’ away from the edge of the driveway until even with the house.
Ms. Van Roo made a motion to close the public meeting and issue a negative RDA for Joan Steele, 73 Ledgestone Road. Ms. Sharkey seconded the motion. Vote: Unanimous.

8:18 PM (NOI-DEP #143-0935) PUBLIC HEARING CONTINUED: 58 Chestnut Street/ DAPRATO, ALFRED.
Ms. Brown stated that the applicant has asked for a continuance.
Ms. Van Roo made a motion to continue the public hearing for (NOI-DEP #143-0935) Alfred DaPrato, 58 Chestnut Street to March 5, 2018 at 7:00 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

8:19 PM PUBLIC MEETING: 0 Southwest Main Street/BEAHN, Derek & Kelly.
Ms. Brown opened the public meeting. Travis Brown of Andrews Survey and Engineering joined the meeting. The applicant is proposing to build a single family house with private septic and well. They are proposing to pave the first 20’-25’ of the driveway and the rest will be reground asphalt. Straw wattles are proposed for erosion control on the downslope side. Straw wattles will be placed across the entrance at the end of each work day.
The majority of the work will be outside the 100’ buffer.
Ms. Van Roo made a motion to close the public meeting and issue a negative RDA for Derek and Kelly Beahn, 0 Southwest Main Street. Ms. Sharkey seconded the motion. Vote: Unanimous.

8:29 PM (NOI-DEP #143-0937) PUBLIC HEARING CONTINUED: 32 Linden Street/LOPES, CORY & NATALIA.
Mr. Lopes joined the meeting. He stated that the BOH does not have an as-built plan for their property. The Commission concentrated on working to fix the violation. Ms. Van Roo recommended pulling back the fill (at least 25’-30’) from the rock by the road, to the only standing tree in the cleared area, to the rock by the shed, scarify the soil, seed with native mix, fix some of the wattles that are breaking down, and add more bales where none currently exist. All this information, the wetland flag numbers, distances from the rocks and the tree, the proposed lawn, straw wattles, native plantings on the edge of the lawn, and measurements should be on a plan. The Lopes will be able to loam and seed on the other side of the 25’. Mr. Lopes will have a plan ready for the next meeting.
Ms. Van Roo made a motion to continue the public hearing for (NOI-DEP #143-0937) Cory and Natalia Lopes, 32 Linden Street to February 5, 2018 at 7:30 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

8:47 PM (NOI-DEP #143-00943) PUBLIC HEARING: 45 Crescent Lane, Lot #10/CRESCENT LANE, LLC.
A Notice of Intent was not submitted. Only an ad was placed in the paper.
It was decided that this item should be removed from future agendas.

8:47 PM (NOI-DEP #143-0944) PUBLIC HEARING: 41 Crescent Lane, Lot #11/CRESCENT LANE, LLC.

9:00 PM (NOI-DEP #143-0941) PUBLIC HEARING: 77 Maple Street/RUIZ, PETER, JR.
Ms. Brown opened the public hearing. Mike Yerka of Civil Site Engineering joined the meeting. A small amount of grading and a small part of the turn-around driveway are within the 50’ buffer. There will be no work within the 25’ buffer. The septic is outside the 100’ buffer.
Mr. Zisk will take photos of the site.
Ms. Van Roo made a motion to continue the public hearing for (NOI-DEP #143-0941) Peter Ruiz, Jr., 77 Maple Street to February 5, 2018 at 7:25 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

DISCUSSION:
1. National Grid: Notification of Utility Maintenance to be done at Pole #19, Davis Street. Mr. Zisk presented some photos of the site. The Commission had no issues with National Grid’s plan.
2. 125 Walnut Street: Erosion Controls. Mr. Zisk stated that the applicant wants to use native leaves to stabilize the slope in lieu of mulch. Eric Bazzett of Heritage Design Group joined the meeting. The plan states that “All disturbed or exposed areas subject to erosion shall be stabilized with mulch or seeded for temporary vegetative cover.” It was the consensus of the Commission that the area be seeded with a native seed mix. No mulch should be used.
3. Request for Local Bylaw Fee Information. Les Stevens of 31 Brookside Drive joined the meeting. He asked to know when the bylaw was established, how the fee is regulated and what Mass. General Law is it tied to. Ms. Brown presented the fee schedule. The public hearing was held 12/4/06. The fees for the general bylaw go into the General Fund. The bylaw is tied to Mass. General Law Chapter 44, Section 53 g. Mr. Stevens asked for a copy of the MGL.
Mr. Stevens asked which board comes first in a process, ZBA or Conservation. The Commission generally does not close a public hearing until all the other boards involved close their hearings.
4. Sign Vouchers.
5. Budget. Ms. Sharkey made a motion to approve the level-funded Conservation Commission budget of $2,789. Mr. Greco seconded the motion. Vote: Unanimous.
6. Minutes: October 16, November 13, & December 4, 2017.
The Commission asked that Ms. Lajoie review the tape for the October 16, 2017 meeting and fill in the question marks in the meeting minutes for 7:09 PM Walnut Street.
Ms. Sharkey made a motion to approve the November 13, 2017 Conservation Commission meeting minutes as amended. Mr. Greco seconded the motion. Vote: Aye-3, Ms. Van Roo abstained.
Approval of the December 4, 2017 Conservation Commission meeting minutes was deferred to the next meeting.

OTHER BUSINESS:
It was the consensus of the Commission that they no longer wish to schedule any public hearings past 8:45 PM.

9:22 PM ADJOURNMENT:
Ms. Sharkey made a motion to adjourn the meeting at 9:20 PM. Mr. Greco seconded the motion. Ms. Sharkey then made a made a motion to retract her motion to adjourn. Mr. Greco seconded the motion. Vote: Unanimous.
