CONSERVATION COMMISSION MEETING MINUTES
MONDAY, FEBRUARY 5, 2018

A meeting of the Conservation Commission was held on Monday, February 5, 2018. Ms. Brown called the meeting to order at 7:00 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman-Left 7:35 PM), Brandi Van Roo
ABSENT:
NON-VOTING: Stephen Zisk (Conservation Agent-Absent)

7:00 PM (RDA) PUBLIC MEETING: 84 Bigelow Road/FULLER, MARILYN.
Ms. Brown opened the public meeting. Ms. Fuller’s son, Christopher Fuller, joined the meeting. Ms. Fuller is asking for permission to remove some rotted trees. Mr. Fuller presented photos. The trees lean over and hang over the swimming and boat areas. The Fullers feel the trees are a safety hazard. The stumps would remain. The Fullers plan to plant blueberry bushes around the stumps. The Commission did not see a need for erosion controls or plantings, however blueberry bushes are allowable.
Ms. Sharkey made a motion to issue a negative RDA for Marilyn Fuller, 84 Bigelow Road with the conditions that the stumps remain and the only permitted plantings are blueberry bushes. Ms. Van Roo seconded the motion. Vote: Unanimous.

7:16 PM (NOI-DEP #143-0942) PUBLIC HEARING CONTINUED: 135 Webster Street/BOYKO, ERIC.
Mr. Boyko joined the meeting. He obtained an as-built for the septic from the Board of Health, however the plan was not in the packet. Mr. Boyko presented a document that showed that the Natural Heritage Line no longer crosses into his property. Mr. Boyko stated that Mr. Zisk has visited his property and has taken photos.
Regarding whether or not there was an open Certificate of Compliance, see Discussion item #2 below. Mr. Boyko filed an NOI for the garage. The previous Order expired before the garage was built. The Commission decided that they need to see the as-built.
Ms. Sharkey made a motion to continue the public hearing for (NOI-DEP #143-0942) Eric Boyko, 135 Webster Street to March 5, 2018 at 7:50 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.

7:30 PM (NOI-DEP #143-0937) PUBLIC HEARING CONTINUED: 32 Linden Street/LOPES, CORY & NATALIA.
Mr. Lopes joined the meeting. He stated that Mr. Zisk visited the site and made the measurements presented on the plan. They measured from the corner of the driveway, 25’ from wetland flag #4 to a rock, 54’ from wetland flag #3 to the end of the driveway, 12’ from the edge of the driveway to the tree, 13’ from wetland flag #2 to the rock and 10’ in from the rock.
Ms. Van Roo read the conditions from the January 8, 2018 meeting minutes.
Ms. Van Roo made a motion to approve the proposed work of pulling back the fill 25’-30’ from the rock by the road to the only standing tree in the cleared area, to the rock by the shed, scarify the soil, seed with native mix, fix the wattles that are breaking down, add more bales where none currently exist, and plant native plantings on the edge of the lawn as per the plan revised 2/5/18 for (NOI-DEP #143-0937) Cory and Natalia Lopes, 32 Linden Street. Ms. Sharkey seconded the motion. Vote: Unanimous.
Ms. Brown told Mr. Lopes that the Order needs to be recorded at the Registry of Deeds, and he cannot start work until it is recorded and the Commission is notified.

8:04 PM (NOI-DEP #143-0941) PUBLIC HEARING CONTINUED: 77 Maple Street/RUIZ, PETER, JR.
Mike Yerka of Civil Site Engineering joined the meeting. A three bedroom house is proposed. The house is outside the 50’. There will be grading in the buffer zone. The Commission asked for some plantings along the northwest side, along the 25’ buffer zone from the well area to the foundation, approximately 70’ long. Mr. Yerka suggested winterberry shrubs and high-bush blueberry.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for Peter Ruiz, Jr., 77 Maple Street (NOI-DEP #143-0941) with the condition that they add a hedgerow of winterberry and high-bush blueberry between the well and the toe of the slope along the 25’ buffer. Mr. Greco seconded the motion. Vote: Aye 3.

8:15 PM (NOI-DEP #143-0944) PUBLIC HEARING: 41 Crescent Lane, Lot #11/CRESCENT LANE, LLC.
Ms. Brown opened the public hearing. Normand Gamache of Guerriere and Halnon joined the meeting. He stated that this project was given an Order of Conditions in 2010. That Order was valid until June, 2017. The applicant is asking that the Commission re-issue an Order.
Mr. Gamache presented the plan. New wattles were installed at the site in the fall. The site has been prepared and is ready to be built upon. The clearing, wells and slurry pits are completed. That work was done before the prior Order expired.
The Commission informed Mr. Gamache that the old Orders for 41 and 45 Crescent Lane need to be closed for work not completed. A discussion was held regarding closing out the prior Orders of Condition. It was decided that requests for partial Certificates of Completion for both lots #10 and #11 need to be filed for the prior Orders of Conditions.
Ms. Van Roo made a motion to continue the public hearing for Crescent Lane, LLC (NOI-DEP #143-0944) 41 Crescent Lane, Lot #11 to March 5, 2018 at 8:00 PM. Mr. Greco seconded the motion. Vote: Aye-3.

8:33 PM (NOI-DEP #143-0943) PUBLIC HEARING: 45 Crescent Lane, Lot #10/CRESCENT LANE, LLC.
Ms. Brown opened the public hearing. Normand Gamache of Guerriere and Halnon joined the meeting. He stated that the Notice was filed for the construction of a driveway. He stated that this project was given an Order of Conditions in 2010. That Order was valid until June, 2017. The applicant is asking that the Commission re-issue an Order.
All the work is between the 100’and 50’ buffers. A stone swale will be constructed and a pipe installed to an existing detention basin. The house and septic are outside the 100’ buffer. Straw wattles are installed. Nothing has changed from the last time this was filed.
It was decided that requests for partial Certificates of Completion for 41 and 45 Crescent Lane need to be filed for the prior Orders of Conditions. See hearing above (NOI-DEP #143-0944).
Ms. Van Roo made a motion to continue the public hearing for Crescent Lane, LLC (NOI-DEP #143-0943) 45 Crescent Lane, Lot #10 to March 5, 2018 at 8:05 PM. Mr. Greco seconded the motion. Vote: Aye-3.

DISCUSSION:
1. Chase Property, Orange Street-Wetland Crossing. Lance Anderson of Heritage Design Group joined the meeting. He asked if the Commission would be amenable to crossing the wetland at the narrowest point. A Notice of Intent would be filed. There is an existing cart path running through the property and existing buildings. Mr. Anderson walked the property with Art Allen of EcoTec last week. The land is in 61a. A discussion was held.
The Commission had no objection to a Notice of Intent being filed.
2. Request for a Certificate of Compliance: Eric Boyko, 135 Webster Street (DEP #143-0743). Ms. Sharkey made a motion to issue a partial Certificate of Compliance for Eric Boyko, 135 Webster Street (DEP #143-0743) with the portions being the house, septic and associated site work, excluding the garage. All other items under this Order were completed to the Commission’s satisfaction. A discussion was held, and the Commission decided that they need to see the as-built. Ms. Sharkey retracted her motion.
3. Request for a Certificate of Compliance: Guaranteed Builders & Developers, Inc., 16 Cottage Colony (DEP #143-0892). Ms. Sharkey recused herself. The Commission reviewed photos taken by Mr. Zisk. Ms. Van Roo made a motion to issue a Certificate of Compliance for Guaranteed Builders & Developers, Inc., 16 Cottage Colony (DEP #143-0892). Mr. Greco seconded the motion. Vote: Aye-3, Ms. Sharkey abstained. Ms. Sharkey rejoined the meeting.
4. FY19 Budget. This was approved at the last meeting.
5. Sign Vouchers. There were no vouchers.
6. Southeast Main Street, Lot #8, Erosion Controls (DEP #143-0894). John Czerwein of Victorian Builders joined the meeting. He is asking for permission to cut trees and remove boulders in order to erect erosion controls for his existing Order of Conditions for the construction of a home with a 16’ wide driveway. The driveway has an easement of 16’ on each side.
Normand Gamache of Guerriere and Halnon joined the meeting. He stated that the driveway is in a 50’ strip that was originally left as a connecting road. It is a shared driveway that has never been cleared. As the project went forward, the decision was made to not extend the road onto another piece of property that the owner had owned. A discussion was held. Ms. Sharkey was not present for this discussion.
A site walk was scheduled for February 12, 2018 at 4:00 PM.
7. MACC Conference. FYI.
8. Minutes: October 16, December 4, 2017 & January 8, 2018.
The Commission asked that Ms. Lajoie review the tape for the October 16, 2017 meeting and fill in the question marks in the meeting minutes for 7:09 PM Walnut Street.
Approval of the December 4, 2017 and January 8, 2018 Conservation Commission meeting minutes was deferred to the next meeting.

OTHER BUSINESS:
Ms. Brown stated that the enforcement order went out for Basile, 50 Southwest Main.

Ms. Van Roo made a motion to adjourn the meeting at 8:37 PM. Mr. Greco seconded the motion. Vote: Unanimous.
