PLANNING BOARD MEETING MINUTES
TUESDAY, SEPTEMBER 25, 2018

A meeting of the Planning Board was held on Tuesday, September 25, 2018. Mr. Marks called the meeting to order at 7:05 PM and announced that the meeting is being recorded and will be available on cable and on the website.

ATTENDANCE:

ABSENT:
NON-VOTING: William Cundiff (Town Engineer)

7:05 PM PUBLIC HEARING CONTINUED: (AQ, SPR, SP-180619) NEW ENGLAND REALTY VENTURES, LLC, Applications for an Aquifer Protection Special Permit, Site Plan Review Permit and a Special Permit, 74 Main Street.
Will Walter of Alfred Benesch & Company joined the meeting. He reviewed the history of the plan. There will be two two-way curb cuts. Widening of Rte. 16 for a left-turn only into the site is proposed. A flush portion of the curb with gravel will be added for tractor trailers to turn and park. Also added to the plan were a dumpster pad, signage, accessibility to the loading space, and a hydrant in front of the property. There is a preliminary design for the septic. The utility pole in Riedell Road will be moved out of the intersection and the drainage will be improved there. A guardrail will be moved. The applicant is willing to add a sidewalk in front of the property. They will deed a slice of property against the back of the road to the Town in case the Town wants to add a sidewalk.
Mr. Cundiff asked that the outlet for the stormwater pond be lowered by 6”.
Jim Noyes of Greenman-Pederson, Inc. stated that the runoff on Main St will be going to the west.
Mr. Zwicker stated that the tree near the stop line near the exit may be a visual obstruction. Jennifer Conley of WSP will check to see how big the trees are going to grow. It was the consensus of the Board to have the applicant relocate the two trees at the entrance to between the tractor trailer lane and parking spot. Mr. Walter agreed.
Mr. Zwicker asked Mr. Walter to add an intake for the middle trench, and detail #2 needs electrical warning tape.
The applicant has not yet filed with Conservation Commission for the work within the roadway.
Mr. Cundiff stated that 300 cu. yards removed from a site within 12 months requires an earth removal special permit. He will condition the decision. The material can be stockpiled on site.
Mr. Noyes stated that he has reviewed the traffic studies submitted over the past three years: 3/2015, a supplemental memo dated 3/2017, and 7/2018. Because the studies were done over a period of three years, some material was missing, such as projections out, however that data would not have significantly changed Mr. Noyes’ conclusions. He suggested that the vegetation to the left be conditioned to be mown out to the street to keep the grasses from growing up. The left turn lane will help with the solar glare by getting the traffic out of the way. All in all, the application will need construction-level drawings for anything going out in the roadway.
The queueing capacity for the drive-through is 14 cars, which is the maximum Mr. Noyes has seen for drive-through windows.
The intersection at Riedell will be a t-intersection with three lanes.
Mr. Noyes reviewed the sign for the commercial business.
The following conditions were agreed upon: a catch basin at the Riedell Road intersection, relocate trees at exit location, add detail on Sheet C 6.4.2-electrical warning tape, reference the earth removal bylaw, sidewalk along Main Street, lower outlet in pond by 6”, entire frontage of site mowed and maintained, and work in Town right-of-way will require going to the Road Commissioner and Conservation Commission.
Ms. Sharkey made a motion to close the public hearing for (AQ, SPR, SP-180619) New England Realty Ventures, LLC, 74 Main Street. Mr. Zwicker seconded the motion. Vote: Aye-6, Mr. Stevens abstained.
Ms. Sharkey made a motion to grant the Aquifer Protection Special permit, Site Plan Review Permit with Sign permit, and Special Permit for a drive-through window with conditions as previously stated for (AQ, SPR, SP-180619) New England Realty Ventures, LLC, 74 Main Street. Mr. Greco seconded the motion. Vote: Aye-6, Mr. Stevens abstained.

DISCUSSION:
1. CMRPC Scope for Zoning/Map Amendments: Conflicting Zones. Mr. Cundiff suggested aligning a zoning district line with a property line, and he suggested starting at the east end of Town. CMRPC pared down the list to properties of significant size and differences in use. Parcels with Residential/Industrial zones are to be looked at first. The members asked that the maps be enlarged. Mr. Cundiff will have them enlarged for the next meeting.
2. Newspaper Fees. The consensus of the Board is that they are in agreement with the chart distributed at the last meeting.
3. Subdivision Regulations. Mr. Cundiff presented the pages of the bylaws where Mr. Stevens had presented a comment. The following changes were made: 22 copies changed to 2 full sized sets, 8 reduced size and an electronic copy, added “RCP” in the first line, and on the last page have just “Planning Agent”. Mr. Cundiff has issues with the whole section on page 27. The Planning Board cannot regulate the Building Permit process, therefore a paragraph under #5 was deleted. Mr. Cundiff will check for a definition section and will check with the Fire Chief regarding a safe turning radius.
4. Earth Removal Special Permit/One-Year Extension: JMT Sleepy Hollow, 439 Northeast Main Street, 34 Davis Street, Phase 3 (ER-170809). This item is to be signed.
5. Decision: Cosma Realty Trust, 202 & 206 Maple Street (DEF-180717). The Board reviewed the Special Conditions.
6. Request for an Accessory Apartment Extension: Ronald Forget, 503 Northwest Main Street (AA-981013). See #10 below.
7. Request for an Accessory Apartment Extension: Tracy Durand, 137 Martin Road (AA-120717). See #10 below.
8. Request for an Accessory Apartment Extension: Kelly Graveson Payne, 141 Northwest Main Street (AA-060621). See #10 below.
9. Request for an Accessory Apartment Extension: Joseph & Meghan Schlesman, 772 Northwest Main Street (AA-030807). See #10 below.
10. Request for an Accessory Apartment Extension: John Hill, 106 Walnut Street (AA-150812). Ms. Sharkey made a motion to grant the Accessory Apartment extensions for Ronald Forget, 503 Northwest Main Street (AA-981013), Tracy Durand, 137 Martin Road (AA-120717), Kelly Graveson Payne, 141 Northwest Main Street (AA-060621), Joseph & Meghan Schlesman, 772 Northwest Main Street (AA-030807) and John Hill, 106 Walnut Street (AA-150812). Mr. Greco seconded the motion. Vote: Aye-7.
11. Minutes: September 11, 2018
Mr. Greco made a motion to approve the September 11, 2018 Planning Board meeting minutes as presented. Ms. Sharkey seconded the motion. Vote: Aye-6, Mr. Stevens abstained.

OTHER BUSINESS:
Mr. Cundiff has spoken with Town Administrator Matt Wojcik about marijuana regulations and Mr. Wojcik said that the existing bylaw should be kept in place and allowed to expire at the end of this year.
iPad Grant Money: Mr. Cundiff could not find any grants.
Future Agenda Items:
Zoning Board amendments for Lakeside Residential: This has been shelved until a grant application is submitted by CMRPC. If approved, CMRPC will come up with a scope of work.
Drone Regulations: Mr. Cundiff sent an email with a press release from the FAA which stated said that drones cannot be regulated locally. There are different FAA regulations for industrial and recreational. Mr. Socrat would like input from Town Counsel regarding where jurisdiction of the FAA ends and Town regulation can begin. Massachusetts does not have drone regulations. A discussion was held. It was decided to keep this item on the agenda.
Solar Regulations: It was decided to target spring Town Meeting for adoption of these regulations.
