CONSERVATION COMMISSION MEETING MINUTES
MONDAY, SEPTEMBER 17, 2018

A meeting of the Conservation Commission was held on Monday, September 17, 2018. Ms. Sharkey called the meeting to order at 7:00 PM. She stated that the meeting is being recorded live for broadcast and future rebroadcasting.

ATTENDANCE:
PRESENT: Tracy Sharkey (Chair), Katiegrace Dudley, Michael Greco (Vice Chair)
ABSENT:
NON-VOTING: Stephen Zisk (Conservation Agent)

7:00 PM (RDA) PUBLIC MEETING: 103 Webster Street/MACLEOD, MICHAEL & MEREDITH.
Ms. Sharkey opened the public meeting. Mr. and Mrs. MacLeod joined the meeting. The Commission reviewed the as-built plan. Ms. MacLeod spoke about two potential locations for their proposed 12’ x 8’ shed.
Ms. MacLeod pointed out two trees they would like to have removed. One is fully dead and the other is partially dead. The trees are 75’-80’ tall and 30’ from their house. The stumps would not be removed. Mr. Zisk has visited the site. A discussion was held. It was the consensus that no erosion controls or special conditions are needed.
Mr. Greco made a motion to issue a negative determination for 103 Webster Street, Michael and Meredith MacLeod with the condition that the trees are not to be stumped. Ms. Dudley seconded the motion. Vote: Aye-2.

7:16 PM PUBLIC HEARING (NOI-DEP#143-0962): 15 Cobblestone Lane/THE WIDAK FAMILY TRUST.
Ms. Sharkey opened the public hearing. Julian Votruba joined the meeting and presented the plan for construction of a single-family home. The area has been reflagged by Applied Ecological Sciences. Mr. Votruba showed the erosion controls on the plan.
Mr. Zisk stated that there is an open Order of Conditions for this property, which has expired. This plan is very similar to the prior plan. Ms. Widak joined the meeting. Mr. Zisk explained that a Certificate of Compliance needs to be requested for the expired Order. Ms. Sharkey explained that a new Order of Conditions cannot be issued until the prior one is closed.
Nancy Stockwell of 11 Cobblestone Lane said she was told when she bought her property that 15 Cobblestone would not be built upon. Every house on the street is 300’ apart. She feels her resale value will plummet because the proposed house is 50’ from the property line. She is also concerned about runoff into the wetlands. Ms. Sharkey explained that the proposed house has been pushed away from the wetland area. She also explained the percolation rate for the property.
Ms. Stockwell stated that there was a lot of dishonesty that will affect her, and she asked the Commission to take that into consideration.
Ms. Dudley made a motion to continue the public hearing for (NOI-DEP #143-0962) 15 Cobblestone Lane, The Widak Family Trust to October 1, 2018 at 7:15 PM. Mr. Greco seconded the motion. Vote: Aye-2.

DISCUSSION:
1. Request for an Extension to Order of Conditions: Whitin Reservoir Watershed District, Whitin Reservoir (DEP #143-0835). Mr. Zisk stated that the Order of Conditions for operating the Whitin Reservoir dam expires on December 5, 2018. The permit was received in 2011 and it is good for three years. Due to the Permit Extension Act, the permit was automatically extended for four more years. Ron Forget joined the meeting. He has submitted a request for a three-year extension.
Mr. Greco made a motion to grant a three-year extension to the Order of Conditions for Whitin Reservoir Watershed District, Whitin Reservoir (DEP #143-0835) to December 5, 2021. Ms. Dudley seconded the motion. Vote: Aye-2.
2. Discuss Order of Conditions: Joseph Leonardo, 269 Southeast Main Street (DEP #143-0888). Mr. Leonardo joined the meeting. His Order expired four months ago, and he is asking for an extension. He has done very little work on the property. He will need to reinstall the erosion controls. He would like to start the work next year.
It was the consensus of the Commission that Mr. Leonardo will need to refile for a minor filing. 85% of the work is outside of the buffer zone.
3. Request for a Certificate of Compliance: John J. Baron, Esquire, 15 Jepherson Drive (DEP #143-0400). This item was postponed.
4. Request for a Certificate of Compliance: Riedell Brook Development Corp., 118 Davis Street, (DEP #143-0647). The area is industrially zoned. The Commission reviewed the as-built and photos of the site. Mr. Zisk stated that 12-13 years ago, wetland was cut through inadvertently. Replication was done. The bond amount has been refunded. The area is back to its vegetative state.
Ms. Dudley made a motion to accept that work is complete and to issue an Order of Conditions for Riedell Brook Development Corp., 118 Davis Street (DEP #143-0647). Mr. Greco seconded the motion. Vote: Aye-2, Ms. Sharkey abstained.
5. MACC Fall Conference. It was decided to order two MACC handbooks and Ms. Dudley will attend the conference.
6. DCR: Changes to Forest Cutting Practices Act (FCPA)/Forestry Memorandum of Understanding (MOU). The Commission reviewed the changes, which related to issuing authority.
7. Minutes: August 6, & August 20, 2018.
Mr. Greco made a motion to approve August 6, 2018 Conservation Commission meeting minutes as amended. Ms. Dudley seconded the motion. Vote: Aye-2.
Approval of the August 20, 2018 Conservation Commission meeting minutes was deferred to the next meeting.

OTHER BUSINESS:
Mr. Zisk stated that Massimo Fontaine’s Eagle Scout project work on the Mosczynski conservation land turned out nice. The Commission reviewed photos of the site.
Ms. Sharkey stated that a tax lien complaint has been presented to Land Court.

8:14 PM ADJOURNMENT:
Mr. Greco made a motion to adjourn the meeting at 8:14 PM. Ms. Dudley seconded the motion. Vote: Aye-3.
