ZONING BOARD OF APPEALS MEETING MINUTES
WEDNESDAY, APRIL 10, 2019

A meeting of the Zoning Board of Appeals (ZBA) was held on Wednesday, April 10, 2019. Mr. Heney called the meeting to order at 7:05 PM in the Community Meeting Room.

ATTENDANCE:
PRESENT: Daniel Heney (Chairman), Michael Fitzpatrick, Jennifer Holland (Alternate), Louis Tusino (Alternate)
ABSENT: John Bombara, Pamela Holmes (Vice Chairman), Sean Holland-all three excused
NON-VOTING: William Cundiff (Town Engineer), Maria Lajoie (Administrative Assistant), Mark Kaferlein (Interim Building Inspector), Jay Talerman (Town Counsel)

7:05 PM DISCUSSION: NORTHBROWN, LLC: NORTH VILLAGE UPDATE:
Atty. Ed Taipale joined the meeting. The cistern is in the ground and full of water. They are on schedule to complete the piping and access this month. All of the units in phase 1 have been sold or under agreement, and that includes the seven affordables. Three of the affordables are sold, two sales are pending within the next week to 10 days, and the other two are under agreement to close when the units are done in late May or June.
To address the concerns regarding the pace of the written amendment to the comprehensive permit, Atty. Taipale met with Mr. Cundiff, Atty. Talerman, Mr. Heney and other Town officials to discuss the issues. The result was a request for an update of the edits to the amendment that Atty. Talerman had prepared, and the plans showing the units. Both were provided to Atty. Talerman and Mr. Cundiff. Tonight, Atty. Taipale would like to resolve the plan going forward in terms of the sales: unit sales and market rate sales.
Atty. Talerman clarified that the original requirement as amended was 4 out of 16 sales would be affordables. The applicant’s request at the last ZBA meeting was 5 out of 20 Occupancy Permits. Mr. Heney’s understanding was that the vote at the last meeting was for phase 1 and then it would go back to 4 out of 16. A discussion was held.
It was decided to go back to the original agreement that 4 out of 16 sales would be affordables, and grant the applicant a waiver for the two market rate units.
Atty. Talerman suggested that the amendment to the amended MOU that the Board of Selectmen recently voted on be “cleaned up”, which could be done by letter. He stated that the zoning permit supersedes the MOU.
Mr. Fitzpatrick made a motion to return to the 4 out of 16 sales standard, to issue the amendment accordingly, but to provide temporary relief from the 4 out of 16 so the applicant can close on the sales of the 14th and 15th market rate units while waiting for the imminent sale of the 4th affordable unit. Mr. Tusino seconded he motion. Vote: Aye-4.


DISCUSSION:
1. MINUTES: March 13, 2019
Approval of the March 13, 2019 ZBA meeting minutes was deferred to the next meeting.

OTHER BUSINESS:
Les Stevens joined the meeting and asked, if the current footprint of a building shows 24’ from the road and he moves the building back 30’ from the road, does he need to come before the ZBA for a variance. Mr. Heney replied in the affirmative because 30’ is still less than the required 50’ setback. Mr. Stevens would need a letter of denial from the Building Commissioner.

7:38 PM ADJOURNMENT:
Mr. Tusino made a motion to adjourn the ZBA meeting at 7:38 PM. Mr. Fitzpatrick seconded the motion. Vote: Unanimous.
