CONSERVATION COMMISSION MEETING MINUTES
MONDAY, OCTOBER 21, 2019

A meeting of the Conservation Commission was held on Monday, October 21, 2019. Ms. Sharkey called the meeting to order at 7:03 PM.

ATTENDANCE:
PRESENT: Tracy Sharkey (Chair), Paul Beckwith, Katiegrace Dudley, Michael Greco (Vice Chair), Arthur Montminy, Mark Mungeam
ABSENT: Eric Harris (Associate-Excused),
NON-VOTING: Stephen Zisk (Conservation Agent)

DISCUSSION:
1. Glen Krevosky: 38 Railroad Avenue. Mr. Krevosky joined the meeting and asked if the Commission had had a chance to visit the site and if not, if they would please do so prior to the public hearing scheduled for 11/4/19. Mr. Zisk showed a video of the site. Mr. Krevosky said that there is old fill at the property. A discussion was held.
2. Request for a Certificate of Compliance: Bonnie Johnson, 42 Hough Road (DEP #143-0948). Byron Andrews of Andrews Survey and Engineering joined the meeting. The Commission reviewed the as-built and photos of the site.
There are two hoses coming out of the house at the right back hand corner that run the length of the house, into the right-of-way, and into the woods. The hoses discharge into the Commission’s jurisdiction and will freeze during the winter. Mr. Andrews said that his client stated that the hoses are for the sump pump. He will speak to his client about their plan for the hoses. Ms. Sharkey suggested an infiltrator under the gravel driveway.
Ms. Dudley noticed that the gravel driveway was extended beyond what was proposed. Mr. Andrews stated that they did not propose the driveway extension, they just located it. Mr. Zisk asked that the applicant remove the material that was extended, reclaim, stabilize it, do a new as-built and take care of the problem with the hoses, all of which can be done under the Request for the Certificate of Compliance. Mr. Andrews will speak with his client.
Ms. Sharkey stated that the limit of work was the exterior boundary of the lot. A solution is needed for what was done outside the limit of work.
3. Request for a Certificate of Compliance: Roy Vaz, 25 Fair View Drive, (DEP #143-0922). Byron Andrews of Andrews Survey and Engineering joined the meeting. Mr. Zisk told Mr. Andrews that they need an as-built superimposed on the proposed plan. The Commission reviewed photos of the site.
4. Minutes: October 7, 2019.
There were no minutes to approve.

OTHER BUSINESS:
24 Shady Lane: Mr. Zisk stated that the property owners wanted him to sign off on a Building Permit for interior work, but in addition, they added removal of a deck. When he went out to the site, he noticed that trees had been taken down, several of which were within the Commission’s jurisdiction. The homeowner has hired Andrews Survey and Engineering, and they are in the process of preparing a Notice of Intent (NOI) for an addition. Mr. Zisk did not sign off on the Building Permit, and he asked the property owners to come to the meeting tonight.
Kathy Maynard of 24 Shady Lane joined the meeting. Mr. Zisk showed photos of the site. Ms. Maynard stated that the trees they removed on the right were removed to make room for a 9’ addition. The trees had gypsy moth damage and were hanging over the house.
Mr. Greco made a motion to issue a $100 fine for tree removal performed within the Commission’s jurisdiction at 24 Shady Lane without filing for a permit. Mr. Montminy seconded the motion. Vote: Aye-5.
Ms. Maynard will be filing an NOI for the addition and the tree removal. Mr. Zisk asked that she flag all trees within 100’ buffer.
Ms. Maynard stated that the builder would like to start removing the 30-year old deck. Ideally, they would like to have the foundation for the addition poured this fall. Ms. Sharkey stated that the deck is within the Commission’s jurisdiction. Mr. Zisk stated that rebuilding the deck requires that Ms. Maynard file with the Commission. Only the interior work and taking down the deck can be done without filing with the Commission. Ms. Sharkey suggested placing the removal of the deck in phase 2 and add that to the NOI. The Commission informed Ms. Maynard about what needs to be on her plan for the filing.

Release of Bond for Wetland Crossing at 149 Southeast Main Street: Margaret Bacon of Civil Site Engineering joined the meeting. Construction was started in September. The client put up two cash bonds: one for the crossing and another for the replication area. Everything was finished last week. Ms. Bacon is working on the as-built. The slopes were hydroseeded with wetland seed mix and plantings done a week ago. Hydroseeding was done again today. The client is asking to release the bond for just the wetland crossing at this time. The Commission reviewed photos of the site.
Ms. Bacon explained why the crossing is at a slightly different angle than proposed.
Mr. Montminy made a motion to release the bond for the wetland crossing at 149 Southeast Main Street. Mr. Greco seconded the motion. Vote: Aye-5.

Chapter 61 Release for Chase at Orange Street (5.91 acres): Ms. Sharkey stated that the Commission voted on this earlier, but the offer fell through. A discussion was held. Mr. Montminy made a motion to recommend to the Board of Selectmen to not exercise their right of first refusal for Chase at Orange Street. Mr. Greco seconded the motion. Vote: Aye-4, No-1.

Request for New Chairs for the Meeting Room: The Commission was asked if they would be willing to buy two chairs for the meeting room. Ms. Sharkey asked Mr. Zisk to find out: how many boards were asked, how many meetings are held in the room, can they purchase just one chair, how much do the chairs cost, and who the chairs are for.

State Forest: Mr. Zisk stated that every diseased tree marked in red at Wallum Lake State Forest will be cut by the State. He asked that the Commission visit the site before the next meeting. Many of the trees are in the picnic area and are a hazard. The trees will not be stumped. Some are outside the Commission’s jurisdiction. The State has filed and they are coming to the next meeting.

Mr. Montminy made a motion to adjourn the meeting at 8:11 PM. Mr. Greco seconded the motion. Vote: Aye-5.
