CONSERVATION COMMISSION MEETING MINUTES
TUESDAY, JANUARY 2, 2007

The meeting was called to order at 7:00pm.

ATTENDANCE
Chairwoman Marylynne Dube, Leon Mosczynski, Michael Yacino, Ralph Dudley, Michael Valliere, Linda Brown, Stephen Zisk (Planning/Conservation Agent) and William Cundiff (Town Engineer). Absent was Brandi Van Roo.


DISCUSSION
1. Zisk said that he contacted the people who own horses that were grazing on the detention pond in the Deer Crossing Subdivision and the people agreed to keep their horses out of that area.
2. FY08 Budget. A MOTION was made by Yacino to level fund their Conservation Commission Expense for FY08 at $3,260, seconded by Brown. VOTE UNANIMOUS.
3. Whitin Reservoir Estates. Cundiff was asked to send a certified letter to the owner of this subdivision advising him to stabilize the site if activity has ceased and to send a copy to the engineer.


7:25 PM PUBLIC HEARING CONTINUED: PYNE SAND & STONE (ANRAD) 34 Davis Street
Present on behalf of the Applicant was Michael Yerka of Yerka/Bacon Engineering. Zisk said that a letter was received from BSC Group stating that they were satisfied with the new flagging. Abutter, Andrew Smith of 21 Monroe Street asked if any Commission members did a site walk and Dube, Yacino and Valliere said that they had. Abutter Jeremy Flansburg of 63 Monroe Street asked if BSC Group was hired to determine the stream classification and Zisk said yes and that BSC Group determined that the stream was intermittent. A MOTION was made by Valliere to close the Public Hearing, seconded by Yacino. VOTE UNANIMOUS. A MOTION was made by Yacino to approve the Abbreviated Notice of Resource Area Delineation (ANRAD) and issue an Order of Resource Area Delineation (ORAD), seconded by Dudley. VOTE UNANIMOUS.


7:45 PM PUBLIC HEARING CONTINUED: ROSENFELD CONCRETE CORP (NOI)
South Street
Zisk received an e-mail from Nancy Prominski of Boston Sand & Gravel, Co. today requesting a continuance of this Hearing in order to review the plan and report submitted by Guerriere & Halnon. The information will also be forwarded to the DEP Wetlands Bureau for their approval. A MOTION was made by Yacino to continue the Public Hearing on Monday, February 5, 2007, at 8:00pm, seconded by Valliere. VOTE UNANIMOUS.


7:50 PM PUBLIC HEARING CONTINUED: GUARANTEED BUILDERS & DEVELOPERS (NOI)
37 Glen Street, Lot #1B
The Commission received a letter today from William Pybas, on behalf of the Applicant, requesting a continuance of this Hearing until the first meeting in March, 2007. A MOTION was made by Yacino to continue the Public Hearing on Monday, March 5, 2007, at 7:30pm, seconded by Brown. VOTE UNANIMOUS.


7:55 PM PUBLIC MEETING: J.A. TAYLOR CONSTRUCTION COMPANY, INC. (RDA)
Charles Street
Present on behalf of the Applicant was Karen Keegan of Andrews Survey. The scope of work includes the construction of two (2) duplex dwellings and associated grading. A small portion of the driveway and associated work are located within the outer limits of a buffer to a bordering vegetated wetland, which is located across a public way and at the bottom of a substantial slope. The plans submitted were dated from 3/3/06 and 4/26/06 and the Commission asked for a current plan. A MOTION was made by Yacino to continue the Public Hearing on Tuesday, January 16, 2007, at 7:31pm, seconded by Valliere. VOTE UNANIMOUS.


8:25 PM PUBLIC HEARING CONTINUED: GUARANTEED BUILDERS & DEVELOPERS (NOI)
37 Glen Street, Lot #2B
The Commission received a letter today from William Pybas, on behalf of the Applicant, requesting a continuance of this Hearing until the first meeting in March, 2007. A MOTION was made by Yacino to continue the Public Hearing on Monday, March 5, 2007, at 7:45pm, seconded by Valliere. VOTE UNANIMOUS.


DISCUSSION
1. Roy Goodwin, 53 Gilboa Street. Zisk was asked by the Commission to contact DEP regarding the debris and work being done on this property which is located on the Mumford River. A MOTION was made by Brown to hire BSC Group to investigate violations on Goodwin’s property on Gilboa Street, seconded by Valliere. VOTE UNANIMOUS.

8: 30 PM PUBLIC HEARING CONTINUED: C & C REALTY TRUST (NOI) 169 Davis Street
Present was Applicant William Gingras. Cundiff asked Gingras what the material was for the existing pipes and headwalls. Gingras said that he would submit a new plan showing the pipes material, headwalls, slopes and erosion control. A MOTION was made by Yacino to continue the Public Hearing on Monday, March 19, 2007, at 7:30pm, seconded by Brown. VOTE UNANIMOUS.


8:40 PM PUBLIC HEARING: MICHAEL GORMAN (ANRAD)
106 West Street
Present on behalf of the Applicant was his representative Michael Yerka of Yerka/Bacon Engineering. The property consists of 12 and ¾ acres. BSC Group reviewing revised plans. Abutter David Brothers of 108 West Street asked what was proposed for this site and Yerka said that nothing was proposed yet. This Hearing is only to determine the wetland location. The back land could be given to the Commission. The Commission asked that a PLS to stamp the plan and topography. A MOTION was made by Yacino to continue the Public Hearing on Tuesday, January 16, 2007, at 8:45pm, seconded by Brown. VOTE UNANIMOUS.


9:05 PM PUBLIC HEARING: WEBSTER DEVELOPMENT (NOI)
13 Charles Street
Present on behalf of the Applicant was his representative Michael Yerka of Yerka/Bacon Engineering. The Legal Notice was advertised incorrectly in the Telegram & Gazette because it indicated one (1) duplex home instead of two (2) duplex homes. Yerka will re-advertise the legal notice. The Commission scheduled a site walk on Friday, January 5, 2007, at 9:00am. A MOTION was made by Yacino to continue the Public Hearing on Tuesday, January 16, 2007, at 8:46pm, seconded by Valliere. VOTE UNANIMOUS.

2. Extension Permit for Order of Conditions: Raymond & Jeannette Fearing, 133 Perry Street. This is on hold and will be signed on 3/19/07 (prior to the expiration date).

At 9:15pm, a MOTION was made by Yacino to adjourn the meeting, seconded by Brown. VOTE UNANIMOUS.
