The meeting was called to order at 7:00pm.

ATTENDANCE
Chairwoman Marylynne Dube, Michael Yacino, Linda Brown, Ralph Dudley, Michael Valliere, Brandi Van Roo, Stephen Zisk (Planning/Conservation Agent) and William Cundiff (Town Engineer). Absent was Leon Mosczynski.


CONSERVATION COMMISSION BUSINESS-DISCUSSION
1. “Nature View Estates” Subdivision: Erosion & Sediment Control. Zisk said that he would e-mail the Commission regarding the results of replacement for the erosion and sediment control.
2. J.A. Taylor, Charles Street Project. Zisk said that hay bales were installed on this site because Taylor had trouble getting straw bales in time for today’s rain storm. The hay bales will be replaced with straw bales as soon as possible.
3. Scott & Debra Valis, 13 Yew Street: Filing a Notice of Intent. The Valis’ are present. The wetlands have been flagged and they are waiting for the report. They will try to file by the 6/18/07 meeting and will contact Zisk if there are any delays.
4. Request for a Certificate of Compliance: Mark LeBoeuf, 72 Mumford Road. The Commission scheduled a site walk for Monday, June 11, 2007, at 5:45pm.
5. Other Site Walks on Monday, June 11, 2007. 1) 2 Gilboa Court at 5:30pm; 2) 796 Northwest Main Street at 6:15pm and 3) 141 Yew Street at 6:30pm.


MEETING MINUTES OF 5/1/07
After review, a MOTION was made by Brown to approve the Meeting Minutes of Tuesday, May 1, 2007, as amended, seconded by Van Roo. VOTE: YES- 5, ABSTAINED-1. VOTE PASSED.


MEETING MINUTES OF 5/14/07
After review, a MOTION was made by Van Roo to approve the Meeting Minutes of Monday, May 14, 2007, as amended, seconded by Yacino. VOTE: YES- 4, ABSTAINED-2. VOTE PASSED.


7:40 PM PUBLIC HEARING CONTINUED: WILLIAM & TEENA PORTER (NOI)
317 South Street
Zisk received an e-mail today from Michael Yerka of Yerka Engineering requesting a continuance to 6/18/07. A MOTION was made by Brown to continue the Public Hearing on Monday, June 18, 2007, at 8:15pm, seconded by Yacino. VOTE UNANIMOUS.


COMMISSION DISCUSSION CONTINUED
6. Public Lands Preservation Act (Section 542 aka the Article 97). The Commission received a letter from the Mass Association of Conservation Commissions dated 5/30/07 stated that they endorsed this Act and are asking our help by writing letters to our Senator and Representative supporting this Act. After discussion, a MOTION was made by Yacino to endorse the concept of the Public Lands Preservation Act, seconded by Van Roo. VOTE UNANIMOUS. Chesley will be asked to send a letter to Senator Moore and Representative Kujawski and to send a copy MACC.


7:55 PM PUBLIC HEARING: BRIAN LACEY (NOI)
141 Yew Street
Present on behalf of the Applicant was Seth Lajoie of Seth L. Lajoie & Associates. Lajoie was to submit a plan but we never received it in time for the meeting in order for Zisk to review it. An Enforcement Order was issued to the Lacey’s for clearing trees within the buffer zone and wetland resource area. There are no future plans to stump. A MOTION was made by Yacino to continue the Public Hearing on Monday, June 18, 2007 at 8:30pm, seconded by Valliere. VOTE UNANIMOUS.


8:10 PM PUBLIC HEARING CONTINUED: CHRIS PODLES (ANRAD)
Northwest Main Street
The Commission received a letter from Benjamin Gilmore of Gilmore Consultants dated 5/31/07 requesting a continuance of this Hearing on behalf of the Applicant. A MOTION was made by Yacino to continue the Public Hearing on Monday, July 16, 2007, at 7:45pm, seconded by Brown. VOTE UNANIMOUS.


COMMISSION DISCUSSION CONTINUED
7. Received a Memo from the Board of Selectmen’s Office stating that they will be hosting a meeting on Monday, June 18, 2007 at 7:00pm regarding Expedited Permitting in accordance with MGL Ch. 43D. The Commission has Public Hearings that evening and is unable to attend. Van Roo is concerned about the wording “necessary regulation/bylaw changes necessary”. Van Roo was appointed by the Chairwoman to attend this meeting on the Commission’s behalf.

At 8:20pm, a MOTION was made by Yacino to adjourn the meeting, seconded by Van Roo. VOTE UNANIMOUS.
