The meeting was called to order at 7:04pm.

ATTENDANCE
Chairwoman Marylynne Dube, Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Brandi Van Roo, Stephen Zisk (Planning/Conservation Agent) and Maria Chesley (Administrative Secretary).


7:04 PM EXECUTIVE SESSION: EVENINGSIDE REALTY TRUST,
“Preservation Park”, Conservation Drive, Lot #23
To discuss the strategy with respect to litigation (MGL Chapter 39, Section 23B)
At 7:04pm, a MOTION was made by Yacino to go to Executive Session for the above mentioned matter and will return to regular session, seconded by Brown. VOTE UNANIMOUS.


7:25 PM CONSERVATION COMMISSION BUSINESS
1. Application for Conservation Commission. The Commission received a copy of an Application for Boards/Commissions from the Board of Selectmen dated 8/9/07. David Windoloski, 48 Orange Street is interested in becoming a member of the Conservation Commission. A MOTION was made by Yacino to ask the Board of Selectmen to appoint David Windoloski as an Associate Member of the Commission, no one seconded and discussion continued. Dube asked Zisk if the opening was advertised on cable TV and Zisk said that he would find out. A MOTION was made by Brown to advertise the opening on Cable TV (Channel 11), seconded by Dudley. VOTE: YES-5, ABSTAINED-1. VOTE PASSED. The Commission asked Chesley to write David Windoloski a letter and invite him in to the next meeting to observe.


7:38 PM PUBLIC HEARING CONTINUED: GUARANTEED BUILDERS & DEVELOPERS (NOI)
37 Glen Street, Lot #1B
The Commission received a letter from William Pybas on behalf of Louis Tusino (GBI) dated 8/16/07, requesting a continuance of their Public Hearing. A MOTION was made by Yacino to continue the Public Hearing on Monday, January 7, 2008 at 7:30pm, seconded by Brown. VOTE UNANIMOUS.

7:39 PM PUBLIC HEARING: DEAN & LAURA KATRAGJINI (NOI)
8 Linden Street
Present were the Applicants and their representative Robert Murphy of Murphy & Associates. The Commission could not open the Public Hearing because Murphy did not bring a copy of the Legal Notice from the Telegram & Gazette. Murphy submitted pictures for the file. Zisk mentioned to Murphy that the Commission wants to know what the status of the stream is (intermittent or perennial). A MOTION was made by Yacino to continue the Public Hearing on Tuesday, September 4, 2007, at 7:45pm, seconded by Brown. VOTE UNANIMOUS.


7:46 PM PUBLIC HEARING CONTINUED: GUARANTEED BUILDERS & DEVELOPERS (NOI)

The Commission received a letter from William Pybas on behalf of Louis Tusino (GBI) dated 8/16/07, requesting a continuance of their Public Hearing. A MOTION was made by Yacino to continue the Public Hearing on Monday, January 7, 2008 at 7:45pm, seconded by Brown. VOTE UNANIMOUS.


7:48 PM PUBLIC HEARING CONTINUED: MOBIL PIPE LINE COMPANY (NOI)
Ridge Trail & Northwest Main Street
Mosczynski recused himself because he is an abutter. Present was Jeff O’Donnell and Cliff Schindell of Coler & Colantonio. O’Donnell said that they addressed the Commission’s comments and submitted a revised plan. The work to be done would impact 6,000 square feet. Zisk asked if they could relocate the rectifier pole. Another issue discussed was the legality of the easement and the Commission was given a copy. O’Donnell submitted plans showing the cross section and erosion control. The design change was to install temporary PVC pipes through the workspace into the wetland so that water and sediment won’t collect. Zisk asked if they were going to dewater and O’Donnell said yes within the vicinity of the pipe line. O’Donnell also said that it would take about a week to do the work and that they would be 5-feet to 101-feet off the road into the wetland. There is no place to leave the excavator so they will take it to the Mobil office and leave it there every night. Shirley Mosczynski, abutter, is concerned about the easement line and said that there is no indication of it on her deeds (she and her husband bought the property from the Sanborn’s) or right of way on the map either. She found markers on her property and wondered what was going on. Yacino said that Mobil Pipe Line has to prove the right of way and need permission from the Mosczynski’s to enter their property. A MOTION was made by Yacino to continue the Public Hearing on Monday, October 1, 2007, at 8:00pm, seconded by Brown. VOTE UNANIMOUS.


8:14 PM PUBLIC HEARING CONTINUED: LOUIS TUSINO (NOI)
103 Shore Road
The Commission received a letter from Louis Tusino dated 8/16/07, requesting a continuance of his Public Hearing. A MOTION was made by Yacino to continue the Public Hearing on Monday, January 7, 2008 at 8:00pm, seconded by Brown. VOTE UNANIMOUS.


DISCUSSION
1a. James Kollett, 72 Pine Street: The Commission received two letters from Michael Yerka of Yerka Engineering date 8/15/07 requesting the town’s wetland consultant review the status of the stream.
1b. Joel Smith, 45 Martin Road: Requesting that the Commission to verify if Southwick Brook is intermittent.
A MOTION was made by Brown to have both of the above owners either file an ANRAD or an RDA, seconded by Van Roo. VOTE UNANIMOUS.


8:28 PM PUBLIC HEARING CONTINUED: SCOTT & DEBRA VALIS (NOI)
13 Yew Street
Present were Scott & Debra Valis. Valis said that he put 40-feet of stone down, rip rap and removed the stockpiled manure with a trailer. The Commission said to add water bars as a condition. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions, seconded by Brown. VOTE UNANIMOUS.


8:36 PM PUBLIC HEARING CONTINUED: LAWRENCE IVEY (NOI)
92 Webster Street
Present on behalf of the owner was Steven Donatelli of Shea Engineering. The scope of work is clearing, excavating and grading to repair a septic system that is located within the 100-foot buffer zone behind the driveway in the lawn area. Proposed is a 6 trench leaching system 81-feet from the bordering vegetated wetland. The wetlands go 70-feet into the woods. The straw bale line is lower gradient of construction. The Board of Health approved the plan but Zisk asked if the taxes have been paid yet and Donatelli said the last he knew, the $1,600 had not been paid yet. A MOTION was made by Yacino to continue the Public Hearing on Tuesday, September 4, 2007, at 8:00pm, seconded by Brown. VOTE UNANIMOUS.





DISCUSSION
1. MACC Conservation Commission Day, Wednesday, September 19, 2007. Dube said that she would attend.
2. Building/Space Needs Survey. Dube said that she would attend this meeting on behalf of the Commission.
3. Received a letter from Heritage Design Group requesting a one-year Extension Permit for ORAD. North Village, North Street. The Commission said that this ORAD Permit had expired and the Applicant must re-file. A MOTION was made by Brown to deny an extension for this ORAD Permit because it had expired, seconded by Van Roo. VOTE UNANIMOUS.


8:45 PM PUBLIC MEETING: DOUGLAS METHODIST CHURCH (RDA) Gleason Court
Present on behalf of the Church was Joel Smith, Ken Jussaume, Chester Roaf and Richard Pawlowski. They are requesting permission to pave the parking lot behind the Methodist Church. The insurance company suggested that the area be paved for liability reasons because the water puddles up and in the winter it freezes. The water will be pitched toward the catch basins on Gleason Court. Van Roo asked that straw bales be placed and replicate when finished the project. Smith said that they will re-seed and remove the stumps. Yacino said the water runoff issue has always been that way. A MOTION was made by Yacino to issue a Negative Determination of Applicability, with conditions, seconded by Brown. VOTE UNANIMOUS.


MEETING MINUTES OF 8/6/07
After review, a MOTION was made by Brown to approve the Meeting Minutes of Monday, August 6, 2007, as amended, seconded by Dudley. VOTE UNANIMOUS.
