The meeting was called to order at 7:07pm.

ATTENDANCE
Chairwoman Marylynne Dube, Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Brandi Van Roo and Stephen Zisk (Planning/Conservation Agent).


DISCUSSION: Stormwater Bylaw
The Commission received comments from Kopelman & Paige. The Commission will review the comments at their next meeting at 7:00pm.


7:30 PM PUBLIC HEARING CONTINUED: ROSENFELD CONCRETE CORP (NOI)
South Street
Present on behalf of the Applicant was Attorney Chip Nylan. Three issues were presented: a) what to do with the property in the future, b) no need to remove the crossing, and c) storm event protection. Rosenfeld wants to stabilize the site without removing the crossing and remove the material from the wetlands. The original Order of Conditions issued by the Douglas Conservation Commission was recorded. The Superseding Order of Conditions issued by DEP was never recorded at the Registry of Deeds. A MOTION was made by Yacino to postpone discussion to 8:25pm, seconded by Dudley. VOTE UNANIMOUS.


7:45 PM PUBLIC HEARING CONTINUED: DEAN & LAURA KATRAGJINI (NOI)
8 Linden Street
Present were the Applicants and their representative Robert Murphy of Murphy & Associates. The Legal Notice was submitted. The scope of work is the construction of a single-family home. The work is to be done in the buffer zone of a bordering vegetated wetland. Murphy feels that the stream is intermittent. It is a dark blue line on the GIS Map indicating that it is a perennial stream. Murphy indicates that the stream bed has been dry for four (4) consecutive days. The Board of Health has no determination of the septic system as of today. The house is 20-feet from the edge of the wetland. The erosion control barrier will be a straw bale dike. The trash on the site is being removed by hand. Murphy states that there is no evidence of petroleum products in the ground. Samples were sent out to the lab for testing by the Applicants. Abutter, Rene Malo of 102 Linden Street states that the Applicants are trying to clean up the site and build a house and doesn’t understand why the Commission would prohibit them from going forward. A MOTION was made by Yacino to continue the Public Hearing on Monday, September 17, 2007, at 7:30pm, seconded by Brown. VOTE UNANIMOUS.


8:00 PM PUBLIC HEARING CONTINUED: LAWRENCE IVEY (NOI)
92 Webster Street
Present on behalf of the Applicant was Steven Donatelli. Donatelli said that the taxes have been paid. A MOTION was made by Brown to close the Public Hearing and issue an Order of Conditions, seconded by Yacino. VOTE UNANIMOUS.


8:15 PM DISCUSSION: Gift of Land
John Gosselin
The 28 acre parcel in question is located off of South Street and Chestnut Street along Tinkerville Brook. A MOTION was made by Yacino to allow Zisk and Cundiff to pursue and assist John Gosselin in the donation of land by the end of this year and also to allow Zisk and Cundiff to contact Town Counsel on the Commission’s behalf, seconded by Mosczynski. VOTE UNANIMOUS.


8:30 PM PUBLIC HEARING CONTINUED: ROSENFELD CONCRETE CORP (NOI)
South Street
Present on behalf of the Applicant was Chip Nylan. Nylan proposes to just do the stabilization of the site and not do work to the crossing. Nylan said that they would revise the plan to show sediment removal and bank stabilization only.
A MOTION was made by Yacino to continue the Public Hearing on Monday, October 1, 2007, at 8:15pm, seconded by Brown. VOTE UNANIMOUS.


DISCUSSION
1. Beaver Dams: Emergency Protocol. The handout pertains to health and safety and filing with the Board of Health for a permit. Discussion: A beaver dam was breached off of Pine Street. The Board of Health and Police Department documented the site. The Commission also went out to the site. Yacino suggests the Commission issue an Enforcement Order to the owner of the property and stipulate that they file a Notice of Intent on or before 9/10/07 no later than 5:00pm. A MOTION was made by Yacino to issue an Enforcement Order to the property owner, seconded by Van Roo. VOTE UNANIMOUS.

At 8:50pm, a MOTION was made by Yacino to adjourn the meeting, seconded by Dudley. VOTE UNANIMOUS.
