The meeting was called to order at 7:21pm.

ATTENDANCE
Chairwoman Marylynne Dube, Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Brandi Van Roo, Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Chesley (Administrative Secretary).

The Commission came out of Executive Session at 7:21pm. A MOTION was made by Yacino to affirm that the Executive Session Meeting Minutes for Paul Brule of Birch Hill Road and Kerney Road will be available to the public, seconded by Mosczynski. VOTE UNANIMOUS.


MEETING MINUTES OF 8/20/07
The Commission asked Chesley to contact Conservation Commission applicants David Windoloski and Angela Saunders and invite them in to their meeting on 10/15/07 at 7:00pm. After review of the minutes, a MOTION was made by Yacino to approve the Meeting Minutes of Monday, August 20, 2007, as amended, seconded by Van Roo. VOTE UNANIMOUS.

7:34 PM PUBLIC HEARING CONTINUED: ED’S CONSTRUCTION, INC. (NOI)
88 West Street
The Commission received a letter from Lisa Barbosa of Marc N. Nyberg Associates dated 9/19/07 requesting a continuance of this Public Hearing because they are waiting for Board of Health approval and if approved, will go to the Zoning Board of Appeals for a setback variance. A MOTION was made by Yacino to continue the Public Hearing on Monday, January 7, 2008, at 8:15pm, seconded by Brown. VOTE UNANIMOUS.
7:35 PM PUBLIC MEETING: ROBERT BRAZEAU (RDA)
130 Main Street
Present was the Applicant Robert Brazeau. The scope of work is to install an in-ground swimming pool using a salt system and not chlorine in the pool. This meeting will open at 7:50pm.


DISCUSSION:
1. James W. Beane, 33 Walnut Street. Beane requested a Certificate of Compliance but after doing a site walk, the Commission instructed him to submit a revised plan of the property for the files. Beane changed the approved plans according to the Order of Conditions that was issued him.
2. Lawrence Ivey, 92 Webster Street. Ivey requested a Certificate of Compliance but after doing a site walk, the Commission said that the area needs to be stabilized with grass.


7:45 PM PUBLIC HEARING CONTINUED: CHRIS PODLES (ANRAD) Northwest Main Street
The Commission received a letter from Benjamin Gilmore of Gilmore Consultants dated 9/26/07 requesting a continuance of this Public Hearing to permit additional time for the consultants to complete all the tasks discussed at the last meeting and to allow for sufficient time for that material to be reviewed. Gilmore is also waiting for the changes to be made to the wetland report. A MOTION was made by Yacino to continue the Public Hearing on Monday, January 7, 2008, at 8:30pm, seconded by Brown. VOTE UNANIMOUS.


SITE WALKS 10/4/07 BEGINNING AT 9:30 AM

7:50 PM PUBLIC MEETING: ROBERT BRAZEAU (RDA)
130 Main Street
Present was the Applicant Robert Brazeau. The scope of work is to install an in-ground swimming pool using a salt system and not chlorine in the pool. A plot plan was submitted showing the swimming pool moved slightly to keep away from the basement door area. The Commission asked that he place straw bales in a curve and to contact Zisk to look at their placement prior to construction. A MOTION was made by Yacino to issue a Negative Determination of Applicability, with the condition that straw bales be placed, seconded by Van Roo. VOTE UNANIMOUS.
There will be a Special Town Meeting held on Tuesday, November 27, 2007 at 7:00pm. Zisk said that an Article for the 43D Bylaw will be on this Warrant. (The Wetland Bylaw will have a 120 day period).


8:00 PM PUBLIC HEARING CONTINUED: MOBIL PIPE LINE COMPANY (NOI)
Ridge Trail & Northwest Main Street
Mosczynski recused himself from this Public Hearing. Zisk received an e-mail from Jeff O’Donnell from Coler & Colantonio dated 9/26/07 requesting a continuance of this Public Hearing in order to resolve the issue of the easement on the Mosczynski property. A MOTION was made by Yacino to continue the Public Hearing on Monday, November 5, 2007, at 7:30pm, seconded by Brown.
VOTE UNANIMOUS.


8:15 PM PUBLIC HEARING CONTINUED: ROSENFELD CONCRETE CORP (NOI)
South Street
Present was Nancy Prominski, Robert Bowie and Ron Corriveau. A revised plan was submitted. Prominski said that they would stay away from the wetland crossing and replicate around that area. Cundiff said that the letter from Kopelman & Paige suggests that it be stated in the conditions that Rosenfeld Concrete stay away from the wetland crossing and if the property is sold, a letter shall be provided to the Commission. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions with special conditions and the recommendations of Jonathan Eichman of Kopelman & Paige (Town Counsel), seconded by Mosczynski. VOTE UNANIMOUS. The Commission will sign the Order of Conditions at the next meeting.


*The Commission will do a site walk on Hemlock Street regarding the paving of the road.


8:30 PM PUBLIC MEETING: GEORGE LeBLANC (RDA)
56 Bigelow Road
The owner is present. The scope of work is to remove a tree stump, repair the stone wall and loam and seed that area. LeBlanc said that to remove the stump he would be pulling it out with a back hoe because the stump is very large and also said that it would be a one day job. He will be using the same material to repair the wall. Dube requests that a condition be added that states “If the equipment is to remain on site, keep it in the driveway or away from the resource area and straw bales are to be placed on upside of the wall”. A MOTION was made by Yacino to issue a Negative Determination of Applicability with the above conditions, seconded by Dudley. VOTE UNANIMOUS. Dube asked LeBlanc to contact Zisk before the work begins.


8:45 PM PUBLIC MEETING: MICHAEL FINAMORE (RDA)
155 Webster Street\
Present were Applicants Michael Finamore and Dianne Hunter. The scope of work is to install a 4-foot chain link fence and gate 160-feet long. Finamore said he would be using a post hole digger. The Commission had no issues with this request. A MOTION was made by Brown to issue a Negative Determination of Applicability, seconded by Van Roo. VOTE UNANIMOUS.


ADJOURNMENT
At 8:55pm, a MOTION was made by Yacino to adjourn the meeting, seconded by Brown. VOTE UNANIMOUS.
