The meeting was called to order at 7:09pm.

Chairwoman Marylynne Dube, Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Brandi Van Roo, David Windoloski, Angela Saunders (Associate Member), Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Chesley (Administrative Secretary).

1. Manchaug Pond. Dube and Mosczynski recused themselves. Present were William & Karen Staruk to inform the Commission that Guilford of Maine/Interface Fabrics has lowered the water level of the pond and are asking for the Commission’s help to get the water level back up to where it should be. Yacino told the Staruk’s it was his understanding that Phil Nadeau of DEP has taken the lead and wants to handle this. Karen said that she and her husband have been in contact with Representative Kujawski and Senator Moore and they also said that Guilford did not get a permit to do the work in Sutton. The Commission said they would help if they could.
2. Road salt & sand in town areas. (Dube & Mosczynski returned). Zisk put together a map of targeted areas where outfalls may feed directly into water bodies. Yacino handed out his letter to the members. Yacino said a couple examples of targeted areas were Caswell Court to Yacino Drive and also Cook Street. Cundiff said that with NPDES, a town wide plan could be developed (costs, data, etc). A MOTION was made by Brown to move forward with a plan of action, seconded by Mosczynski. VOTE UNANIMOUS. Yacino asked the members for input. Van Roo asked the members to contact Cundiff or Zisk with sites of concern. Mosczynski said that the streets should be swept the earlier the better and he wants to know where the debris (salt & sand) is being dumped after it is swept.

34 Peters Cove Road
Dudley recused himself. Present was owner Tony Brookhouse and his representative Michael Weaver of Guerriere & Halnon. The scope of work involves the demolition of two structures and reconstruction of a single family residence, well, septic system and associated site work located on the northwest side of Whitin Reservoir. This lot is 90,000 square feet with the house being 41-feet back from the reservoir, the septic system is 51-feet from the reservoir and the limit of excavation is 17-feet from the reservoir. Weaver said that the Applicant has to go before the Zoning Board of Appeals next week for a Special Permit to raze the pre-existing, nonconforming structures and they need Board of Health approval also. Weaver said that the Applicant wants to take down some trees in front of the water. Weaver said that the house will be within the footprint of the two existing structures. Abutter Keith Glode asked what size the house will be and Weaver said it will be a two-story 28-feet wide and 58-feet long. The Commission scheduled a site walk for 5/14/08 at 1:30pm and asked Weaver to stake the four corners, well, septic system and to mark the trees that the Applicant wants to take down. Brown asked Weaver to move the house out of the 50-foot and 25-foot buffer zone per the Town Bylaw. Weaver said that he would look at moving the house but can’t move the septic system because the septic system is 68-feet from the well. Weaver will do a revised plan and the house will be 8-feet shorter. A MOTION was made by Yacino to continue the Public Hearing on Monday, May 19, 2008, at 8:45pm, seconded by Brown. VOTE UNANIMOUS.

125 Walnut Street
Present on behalf of the Applicant was Karen Keegan of Andrews Survey. A revised plan was submitted (revised flags & wetlands by BSC Group). Keegan said Crossman met with BSC Group. Flag #65 was removed and Keegan will have to revise this plan. Keegan said that the specific plantings are on the plan and this will also need to be revised due to Flag #65. The Commission will do a site walk on 5/14/08 at 2:00pm. A MOTION was made by Yacino to continue the Public Hearing on Monday, June 2, 2008 at 7:30pm, seconded by Brown. VOTE UNANIMOUS.
Keegan left and Chesley said that there was an opening on 5/19/08 at 8:30pm. Zisk went to get Keegan and Yacino asked her if this date and time is agreeable to her and she said yes. A MOTION was made by Yacino to reconsider the previous vote, seconded by Van Roo. RECONSIDERATION PASSED UNANIMOUSLY. A MOTION was then made by Yacino to continue this Public Hearing on Monday, May 19, 2008, at 8:30pm, seconded by Van Roo. VOTE UNANIMOUS.

103 Shore Road
The Commission received a letter from William Pybas on behalf of the Applicant dated 5/6/08 requesting a continuance of this Hearing. A MOTION was made by Yacino to continue the Public Hearing on Monday, June 2, 2008, at 7:30pm, seconded by Van Roo. VOTE UNANIMOUS.

42 Conservation Drive
Present was Applicant Tammy Kasper. Kasper submitted a revised plan showing the swimming pool being moved closer to the house. The Commission had no other concerns but told her to place straw bales down gradient of proposed work. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions. VOTE UNANIMOUS.

76 Old Farm Road
Present was Applicant David Raia. The scope of work is to install a drain within the 100-foot buffer zone to control drainage to remove water from the property. Van Roo said that she was unclear as to what was going on with this property and Zisk and Cundiff explained the situation to her. A MOTION was made by Yacino to issue a Negative Determination of Applicability with the condition that straw bales be placed down gradient of the proposed work and to loam and seed exposed gravel, seconded by Dudley. VOTE UNANIMOUS.

2. Certificate of Compliance: Neal & Christine Taylor, 140 Southeast Main Street
3. Order of Conditions: Shawn Kasper, 42 Conservation Drive

1. FYI: The Commission received a copy of a letter from the Department of the Army dated 4/23/08 to Joel & Judith Smith regarding the Dam Safety Order for Wellman Pond Dam.

At 8:55pm, a MOTION was made by Yacino to adjourn the meeting, seconded by Van Roo. VOTE UNANIMOUS.
